1. Agreement to Terms

Welcome to Daily Bite. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Daily Bite ("we," "us," or "our") governing your access to and use of our iOS mobile application, website, and related services (collectively, the "Services").

By downloading, installing, accessing, or using Daily Bite, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue all use of our Services and uninstall the application.

These Terms apply to all users of the Services, including both free users and paid subscribers. Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Description of Service

Daily Bite is an iOS mobile application that uses artificial intelligence to analyze food images and provide educational nutritional information. Our Services include:

• Food Image Capture: Camera functionality to photograph meals and food items
• AI-Powered Analysis: Third-party AI services (Google Gemini, Grok, Perplexity AI) analyze images to identify foods and estimate nutritional content
• Nutritional Estimates: Calorie counts, macronutrient breakdowns (protein, carbs, fat, fiber), and meal composition analysis
• Educational Health Insights: Information about food factors including sugar content, sodium levels, glycemic impact, and other nutritional characteristics (for educational purposes only)
• Meal History: Storage and display of your scanned meals, analysis results, and food images
• Research Sources: Links to peer-reviewed research and citations supporting nutritional information

Note: Daily Bite provides general educational information about food and nutrition. We do NOT provide personalized medical advice, dietary plans, or health recommendations tailored to individual medical conditions.

3. Health, Nutrition, and Safety Disclaimers

Daily Bite does not provide medical advice, nutritional counseling, or professional health services. All calorie estimates, nutritional insights, and food identifications are automated approximations and may be incomplete or inaccurate.

• Calorie and nutrition estimates are approximations only
• The Service is not intended to diagnose, treat, cure, or prevent any disease
• You should consult licensed professionals for dietary or medical guidance
• The Company is not liable for inaccuracies in calorie counts or food identification

4. Eligibility; Age Requirements

You represent and warrant that You are at least 13 years old.

If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be fully responsible for all activities conducted using the Service.

5. User Accounts

To use certain features of our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for all usage and activity on your account.

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion.

6. Subscription, Billing, and In-App Purchases

Purchases and subscriptions are processed through third-party platforms such as the Apple App Store. Their terms govern payment processing, renewals, and refunds.

Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.

7. Prohibited Uses

You agree not to:

• Upload violent, explicit, or unlawful content
• Reverse engineering or competitive analysis
• Circumventing protections or unauthorized access
• Uploading images of individuals without lawful consent
• Interfering with the Service's operation

8. Intellectual Property

All rights in the Service (excluding User Content) are owned exclusively by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.

By submitting User Content, You represent that You own or have rights to it. You grant the Company a worldwide, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, analyze, process, modify, publish, and create derivative works from the User Content to operate and improve the Service, including training AI models.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

By using our Service, you consent to the collection and use of information in accordance with our Privacy Policy.

10. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided without warranties of any kind, express or implied. The Company disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

11. Limitation of Liability

To the maximum extent allowed by law, our total liability shall not exceed the greater of:

• The amount you paid in the preceding 12 months, or
• One hundred dollars (USD $100)

We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.

12. Governing Law

These Terms are governed by the laws of the United States. You agree to jurisdiction in U.S. courts.

13. Changes to These Terms

We may update these Terms from time to time. Updates become effective when posted. We may notify you by email or through the app for material changes.
